AquaKara Limited operates this website. These terms explain the website's use and the arrangements relevant to the purchase channel in operation. AquaKara Limited is the seller for Shopify Direct purchases.
The purchase channel
The website provides AquaKara product and campaign information. Campaign pledges, payments and the campaign-specific shipping/payment workflow are handled through Kickstarter/Pledge Manager and their applicable processes. Shopify checkout does not handle Kickstarter pledges. This does not remove any mandatory legal responsibility AquaKara has for the campaign or delivered products.
Your information and capacity
You must have the legal capacity to enter a transaction, or use the service through an authorised adult where required by applicable law. Provide accurate order, contact and delivery information and contact AquaKara promptly if a correction is needed. A minor mistake does not automatically forfeit your legal rights.
Using the website
Use the website lawfully. Do not interfere with its operation or security, misuse its services, or infringe another person's rights.
Website content and branding
AquaKara's website content and branding are protected by applicable intellectual-property laws. Third-party content, platforms and provider materials remain subject to their respective owners' rights.
Product instructions and safety
Check the stated phone compatibility and suitable mounting surfaces, and follow the product's installation, use, charging and safety instructions. These responsibilities do not create a blanket exclusion of mandatory consumer rights or replace the product instructions.
Service and privacy information
Refer to the relevant Shipping & Delivery, Returns & Product Support and Privacy information, and use Contact when you need help. Links are provided when the relevant destination is available. The service policies describe the applicable channel arrangements; they do not remove mandatory rights.
Governing law and mandatory rights
These terms are governed by New Zealand law, subject to the mandatory consumer protections that apply to your location and transaction. Choosing New Zealand law does not remove protections that cannot lawfully be excluded, including applicable EU or UK consumer rights, Australian consumer guarantees, New Zealand Consumer Guarantees Act rights or other mandatory local protections.
Nothing in these terms limits any mandatory consumer rights that apply to your purchase. These terms do not require compulsory arbitration or waive any mandatory right to use a local court, regulator or other available statutory remedy.

Please contact AquaKara if you have a question or concern so we can try to resolve it. Contacting us first is encouraged, but is not a mandatory barrier to any remedy or complaint route available under applicable law.
Changes to these terms
Website terms may be updated prospectively. An update does not retrospectively change the terms of an existing accepted order unless a change is lawfully agreed or required by law. The effective date identifies the current version.
