AquaKara Limited operates this website and is responsible for the personal information it handles in connection with AquaKara enquiries, sales and product support. This policy explains that handling. Other platforms may also handle information under their own privacy policies.
For a privacy question, request or complaint, contact AquaKara Limited at:
This website provides AquaKara information and support in connection with the campaign. Pledges, campaign payments and the campaign-specific shipping/payment workflow are handled through Kickstarter/Pledge Manager and their applicable processes. Their own privacy policies also apply to information they handle.
Information we may handle
The information involved depends on how you use the website, the purchase channel and the services actually provided.
- Website use: technical information generated by your visit may include your IP address, browser or device information, pages requested and interactions with the storefront, together with information from cookies or similar technologies used by the platform or enabled providers.
- Contact and product support: contact details and messages you provide, relevant order or pledge details, and information needed to understand a return or product-support case. Where useful, this may include photographs or video you choose to provide in response to a support request. Please do not send information that is unnecessary for your enquiry.
- Shipping, returns and remedies: delivery details, shipment or tracking information and the information needed to arrange an eligible return, refund, replacement or other applicable remedy.
- Kickstarter/Pledge Manager interactions, where relevant: AquaKara may receive pledge, reward, contact, delivery and status information needed to manage campaign obligations, fulfil rewards or provide support. The campaign platform determines the information it collects and provides through its process.
How we use information
We use relevant information to operate the website, respond to enquiries, process transactions that are available through the selected purchase channel, arrange delivery, and handle returns, refunds and product support.
We may also use information to maintain appropriate business records, protect the website and transactions against misuse or fraud, resolve disputes and meet applicable legal obligations.
Where applicable law requires a legal basis, the basis depends on the activity. It may include taking steps you request or performing a contract, complying with a legal obligation, legitimate interests in operating a secure business and responding to enquiries where those interests are permitted by law, or consent where required.
At initial launch, AquaKara has no newsletter or email-marketing program, no SMS-marketing program and no optional remarketing or advertising-tracking program. AquaKara has not intentionally added Google Analytics, Meta Pixel or TikTok Pixel. Transactional, order and support communications may still be sent when relevant.
Providers and other recipients
Information may be handled by providers to the extent relevant to the services they perform, including:
- Shopify, which supplies the storefront and ecommerce platform;
- payment providers used through Shopify when Shopify Direct payments are available;
- fulfilment, delivery and logistics providers when an order or remedy is arranged;
- providers used to receive and manage Contact or support communications; and
- Kickstarter/Pledge Manager for campaign-specific transactions and related information flows, where relevant.
Some providers act on our instructions for a service, while others determine how they handle information for their own platform or payment services. Their own privacy information may also apply. We do not present every provider as acting only on AquaKara's behalf.
We may disclose relevant information when required by law or reasonably necessary to protect legal rights, address fraud or security issues, or resolve a dispute, subject to applicable law.
AquaKara does not intentionally sell or rent customer personal information.
International handling
Shopify and other relevant providers may handle information in countries other than where you live. The locations and arrangements depend on the services actually used. International handling is subject to the protections and safeguards required by applicable law. Contact us for information about international handling that applies to your information.
How long we keep information
We keep personal information for as long as reasonably needed for the purposes described in this policy. Relevant criteria include whether an enquiry, order or support case is ongoing; applicable business, tax or other legal record-keeping requirements; the need to establish, exercise or defend legal claims; and proportionate security or fraud-prevention needs. When information is no longer needed, it should be deleted or de-identified, subject to applicable legal requirements and the relevant system's handling of backups.
Security
We aim to use reasonable technical and organisational safeguards appropriate to the information and the risks involved. No website, system, storage method or transmission can be guaranteed completely secure.
Your privacy requests and complaints
Depending on the law that applies, you may have rights to request access to or correction of your information, deletion, restriction of processing, portability, or to object to particular processing. Where processing relies on consent, you may be able to withdraw that consent without affecting the lawfulness of earlier processing. These rights apply only where provided by law and may be subject to lawful exceptions.
Send privacy requests or complaints to privacy@aquakara.com and explain what you need. We may ask for information reasonably needed to confirm your identity or understand the request, and will handle the request within the requirements of applicable law. You may also complain to the relevant privacy regulator where that right is available; contacting AquaKara does not prevent you from using that right.
Cookies and similar technologies
The storefront uses cookies and similar technologies to support functions such as operating the site, security, preferences and, when available, the shopping cart or checkout. Shopify and other enabled providers may use additional technologies. The technologies actually used, their purposes and the choices available depend on the storefront configuration and applicable law. Contact us if you need information about the technologies relevant to your visit.
Where an external video is configured, loading its embedded player may send technical information to the video provider and may involve that provider's cookies or similar technologies. An external provider's privacy information also applies. A privacy-enhanced player setting does not by itself mean that no information is sent.
You can use your browser's available cookie controls and any privacy choices made available on the storefront. Blocking technologies needed for a function may affect that function. Any right to choose or withdraw consent for particular technologies applies as provided by law.
Children and minors
The website is intended for a general audience and is not directed at children. We do not seek information from children where parental or guardian authorisation is required. If you believe a child has provided personal information without authorisation required by law, contact us so the matter can be considered under the applicable requirements.
Changes to this policy
This policy may be updated to reflect changes in our activities or legal requirements. The effective date will identify the current version. Where applicable law requires notice of a material change or further consent, that requirement applies.
